Cell Phone Traffic Ticket Legal Issues

Cell Phone Traffic Ticket Law:

Most states have strict traffic laws regarding use of a cell phone while operating a vehicle. In California, it is completely prohibited to text while driving and it is prohibited to talk on a cell phone without a hands-free device. Similarly, drivers under the age of 18 cannot use a cell phone at all, even with a hands-free device. Bus drivers are also prohibited from any cell phone usage while driving, even with a hands-free device. Violating these laws can result in an expensive cell phone ticket.

There are some exceptions and variations in these laws that effect cell phone tickets. For example, drivers over 18 may dial a phone number while driving but must use a hands-free device or speaker function to talk. If an earpiece is used, it cannot cover both of the driver's ears. If the driver is under 18, he or she cannot use any type of wireless device at any time, whether hands-free or not. The only exception is if the driver is making an emergency phone call. Typing texts, reading texts, and sending texts are prohibited for all drivers with no exceptions.

Cell Phone Traffic Ticket Legal Issues:

Fines associated with cell phone tickets vary depending on the law violated and the amount of times the driver has already been cited for the same violation. The standard fines and details of cell phone tickets in California are as follows:

  • For using a handheld cell phone while driving, a first offense results in a $76 ticket and a second offense results in a $190 ticket. Points are not added to your driving record for this violation. Officers can pull over a driver solely for this infraction.
  • For drivers under 18 using a hands-free cell phone, a first offense results in a $76 ticket, and a second offense results in a $190 ticket. Officers cannot pull over an under-18 driver solely for this infraction, however if an officer pulls the driver over for another reason, he or she can then cite the driver for this violation.
  • For texting while driving, the first offense is worth a $20 ticket, while each subsequent offense is worth an additional $50 ticket.
