NAFTA TN Status/TN Visa Immigration Law

NAFTA TN Status/TN Visa Legal Issues

TN NAFTA Visa Definition:

The Trade NAFTA is also known as TN status and TN visa. It is a special status that applies to citizens of the United States, Canada and Mexico. The TN status allows American, Canadian and Mexican citizens the opportunity to work for a limited set of occupations in the United States or Canada. The TN status is similar to an H-1B visa. The TN status set of occupations allows an American, Canadian or Mexican to work up to a year at a time.

Consequences of TN Visas:

Under the TN status, the visa may be renewed in increments of one year. It is not a permanent visa and if there is suspicion among immigration officials that it is being used as a substitute for a green card, they may choose to deny future renewals. Restrictions to the TN status are:

1. TN visas are available to Mexican and Canadian citizens

2. Professions are identified on the NAFTA list

3. The applicant needs to meet specific criteria for the profession
