Criminal Grand Larceny Law

Criminal Grand Larceny Lawyers

Grand Larceny:

the taking of something of higher value. California law states that stealing property that is valued over $950 USD is grand larceny.

There are terms in the California Penal Code that make certain exceptions to the $950 value point. For example, if the items stolen are livestock, agricultural goods, farm goods, a motor vehicle, airplane or a firearm, the crime would be considered grand theft even if the property is under $950 USD. Also, if the property was stolen off of a person's body, the offense would also be considered grand theft, regardless of value, Grand larceny is usually considered a felony, as opposed to petty larceny which is commonly a misdemeanor.

Grand Larceny Legal Issues:

Grand larceny can result in long jail sentences, extremely high fines, a longstanding mark on the defendant's criminal record, probation, parole and/or restitution. The charges depend upon the circumstances of the theft, the criminal history of the defendant, the value of the property stolen, and the nature of the property stolen. In order to convict a person of grand larceny, ALL of the following points must be proven:

  • Personal property was taken
  • The stolen property was kept for even the smallest amount of time
  • The owner of the property did not give consent
  • AND there was intent to take the property and keep it permanently, or keep it long enough to noticeably deprive the owner

What a Criminal Defense Lawyer can do for you:

If you are charged with grand larceny, a criminal defense lawyer can evaluate your case, gather evidence, represent you throughout litigation, and defend your rights. An attorney familiar with criminal grand larceny charges can potentially reduce your charges by proving you rightfully owned the property taken, faced entrapment, had the owner's consent, a mistake was made, or you were intoxicated or under duress at the time of the theft, thus proving you had no proper intent. If found guilty, an experienced criminal attorney can still defend your rights and present a case to have your charges reduced and/or your sentence changed.
