Criminal Trial:

When a criminal case is not resolved through negotiations, it will go to trial. Even if a defendant admitted to committing the crime and plead "guilty", they still have the right to a jury trial.

During a trial, the jury is instructed that the defendant is innocent until proven guilty. The criminal defense lawyers start by presenting opening statements and proceed to call witnesses. Witnesses may or may not be used by the defendant, depending on the case.

When the testimony has been taken, attorneys from both sides present their closing arguments. More instructions are given to the jury and deliberation begins so the jury can reach a verdict. If the jury cannot reach a verdict, the judge discharges the jury and the prosecutor decides if dismissing the charges or seeking a new trial is best.
