Criminal Booking:

Once a person gets arrested, they are taken to the police stations for booking. Booking is the process of recording an arrestee's personal information, such as name, date and place of birth, height and weight, fingerprints and photographs.

During the booking process, a prosecutor is notified and a watch sergeant or supervisor reviews the criminal report. If they decide that there is not enough evidence to take the case to prosecution, they may release the arrestee without filing charges. Those who have been charged with misdemeanors will be required to pay a cash bond instead of serving jail time.

Since booking is not a critical state of the criminal case process, you are not entitled to having a lawyer present during these procedures. Since law enforcement is aware of this, they often try to illicit information from arrestees. It is advised to resist talking, explaining, or saying anything during booking, and to speak with your lawyer after booking.
