What is it?
A contested divorce is a termination or dissolution of a legal marriage where some or all aspects of a separation are not mutually agreed-upon. A contested divorce is generally more costly and time consuming than an uncontested divorce as resolutions must be met as to the merits of the divorce petition or to the terms of the divorce, such as alimony payments, child custody, or the division of assets. These resolutions can be reached either by a settlement agreement between the two parties or by a court judgment.

The statutes in some states permit only one party to petition for a no-fault divorce, where a divorce is initiated based on no fault by either party and the party that files simply wants to end the marriage. In states where a no fault divorce is not permitted, reasons for the divorce, such as adultery or abusiveness, must be stated when filing the petition.
