What is it?
Legal malpractice is a lawsuit filed against an attorney alleging
negligence because of conduct or practice methods on the part of the
attorney that are inconsistent with the standards of legal practice.
What are the standards of law?
Attorneys have a duty to represent their clients following the standards of law. The attorney must:
- Act in a manner that is consistent with the practices of an attorney who possesses ordinary skills and knowledge; and
- Not make judgments that do not follow the status quo for that time in situations that do not call for a judgment to be made.
In some cases, however, the standards of legal practice may call for an
attorney to make a judgment and the law does allow for the attorney to
make that judgment without being held liable for malpractice. There are
many other situations that can affect whether or not a client has a
valid complaint against an attorney for malpractice.
