What is Nurses Unpaid Overtime? Generally, nurses are entitled to receive overtime compensation if they work more than 8 hours a day or more than 40 hours a week. In most states and in California, the overtime rate is generally one and one half times the nurse's regular pay. Overtime must be paid in wages and cannot be compensated by time off and/or goods.   • - They are asked by their employer to arrive early to work and begin working on minor things.
  • - Their employer has knowledge and gave permission for them to take work home.
  • - They are "on call" and ready to report to work when they are at home.
  • - They work overtime on a Friday and are told that they can leave work early within the next week.
  • - While on company business, they need to stay overnight or do travel extensively.
